Cooley Godward Kronish’s Antitrust & Trade Regulation team provides broad expertise matched by the breadth of our client base. Cooley was recently recognized as one of the top-tier firms in the area of antitrust by Chambers USA: America’s Leading Business Lawyers (2007) in its annual listing of the leading practices in the United States.
We handle all aspects of antitrust and trade regulation matters for Fortune 500 corporations, as well as growing companies, in virtually every sector of the economy. Our attorneys have extensive expertise in counseling technology companies, including computer hardware and software, imaging, graphics technology, servers and other networking products, processors, handheld operating systems and devices, servers, B2B electronic platforms and telecommunications. We also advise companies in biotech, aerospace, defense, oilfield services, industrial manufacturing, consumer products, medical devices, pharmaceuticals and financial services.
The 2005 Adobe-Macromedia merger typifies the type of work that places Cooley among the top U.S. firms. Our Antitrust team obtained complete U.S. regulatory clearance—without any divestitures—from the Antitrust Division of the DOJ for this proposed $3.4 billion deal, despite complex competitive questions posed by the DOJ. We also have substantial experience litigating antitrust and criminal antitrust cases, including representing:
- Sumitomo Corporation in two antitrust actions (California and Wisconsin) that sought hundreds of million of dollars in damages stemming from an unauthorized trading scheme by Sumitomo’s chief copper trader
- Mitsubishi Corporation in a federal price-fixing trial in Philadelphia
- A senior officer of Christie’s in the New York-based auction house price-fixing investigation
- One of the largest food processors in a lawsuit alleging monopolization in the purchase of agricultural products
- Tyco Healthcare in a series of five antitrust cases in California, Texas and Massachusetts, involving alleged anticompetitive practices in four separate product lines
We draw upon our experience in both the private bar and as former FTC and DOJ officials to provide mission critical results for our clients in Counseling and Transactional Services as well as Litigation and Arbitration Services. We combine a deep knowledge of the rapidly changing state of the law both in the U.S. and abroad with a practical understanding of the market dynamics in which our clients compete. As a result, we are able to provide expert, practical and timely representation, thus enabling our clients to manage antitrust risk while simultaneously accomplishing their business objectives.
We also provide integrative solutions by working closely with our other leading practices in Mergers & Acquisitions, Technology Transactions, Intellectual Property Litigation, and Life Sciences.
